Bankruptcy - An Overview

In a Chapter 7 bankruptcy, you will keep all of your exempt assets (in about 97% of the cases, all assets are protected in bankruptcy). The main advantage of Chapter 7 bankruptcy is speed. Chapter 13 Bankruptcy consolidates certain debt (usually car loans and past-due payments on a car or home) and lets you pay it off over 3-5 years. Like Chapter 7, you should keep all your assets. Although it is a longer-term commitment, the primary advantages of Chapter 13 are that you can (i) completely remove your second mortgage or HELOC on your house in certain situations; and/or (ii) have lower monthly out-of-pocket obligations by significantly reducing your car and/or home loan payments.
